Terms of Use
Access to and use of the Project Hurricane web site ("The site") is provided by
"Corey Gouker","Dominic Hopton" and "Mark Johnston" ("The Owners")
subject to the following terms:
- By using this site you agree to be legally bound by these terms, which shall take
effect immediately on your first use of this site. If you do not agree to be legally
bound by all the following terms please do not access and/or use this site.
- The Owners may change these terms at any time by posting changes online. Please
review these terms regularly to ensure you are aware of any changes made by the
Owners. Your continued use of this site after changes are posted means you agree to be
legally bound by these terms as updated and/or amended.
Use of the site
- You may not copy, reproduce, republish, download, post, broadcast, transmit
or otherwise use the site content in any way except for your own personal,
non-commercial use. You also agree not to adapt, alter or create a derivative
work from any site content except for your own personal, non-commercial use. Any
other use of site content requires the prior written permission of the Owners (and/or
contributors of the content).
- You agree to use this site only for lawful purposes, and in a way that does not
infringe the rights of, restrict or inhibit anyone else's use and enjoyment of
this site. Prohibited behaviour includes harassing or causing distress or
inconvenience to any person, transmitting obscene or offensive content or
disrupting the normal flow of dialogue within the site.
Disclaimers and Limitation of Liability
- Site content, including the information, names, images, pictures, logos and
icons regarding or relating to the site and/or the owners, its
products and services (or to third party products and services), is provided "AS
IS" and on an "IS AVAILABLE" basis without any representations or any kind of
warranty made (whether express or implied by law), including the implied
warranties of satisfactory quality, fitness for a particular purpose,
non-infringement, compatibility, security and accuracy.
- The Owners will not be liable for any damages,
including indirect or consequential damages, or any damages arising from use or
loss of use, data or profits, whether in contract, negligence or other tortious
action, arising from or in connection with the use of the site.
- The owners do not warrant that functions contained in the site content will be
uninterrupted or error free, that defects will be corrected, or that the site or the
server that makes it available are free of viruses or bugs.
Intellectual Property
- The names, images and logos identifying the site, the owners or third
parties and their products and services are subject to copyright, design rights
and trade marks of the site, the owners and/or third parties. Nothing
contained in these terms shall be construed as conferring by implication,
estoppel or otherwise any licence or right to use any trademark, patent, design
right or copyright of the site, owners, or any other third party.
Contributions to the site
- Where you are invited to submit any contribution to the site and/or owners (including any
text, photographs, graphics, video, audio, or source code) you agree, by submitting your
contribution, to grant the site a perpetual, royalty-free, non-exclusive,
rights and license to use, reproduce, modify, adapt, publish,
translate, create derivative works from, distribute, perform, play, and exercise
all copyright and publicity rights with respect to your contribution worldwide
and/or to incorporate your contribution in other works in any media now known or
later developed for the full term of any rights that may exist in your
contribution, and in accordance with privacy restrictions set out in the sites
Privacy Policy. If you do not want to grant to the site and/or owners
the rights set out above, please do not submit your contribution to the site.
- Further to paragraph 9, by submitting your contribution to the site, you:
10.1 warrant that your contribution;
10.1.1 is your own original work and that you have the right to
make it available to the owners for all the purposes specified above;
10.1.2 is not defamatory; and
10.1.3 does not infringe any law; and
10.2 indemnify the owners against all legal fees, damages and
other expenses that may be incurred by the owners as a result of your breach of the
above warranty; and
10.3 waive any moral rights in your contribution for the
purposes of its submission to and publication on the site and the purposes specified
above.
House Rules for site Communities
- You agree to use the site Communities (including Message Boards) in accordance
with the following House Rules:
Your posts:
- Contributions must be civil and tasteful;
- No rude or abusive behaviour (flaming or trolling)- postings must be
constructive and polite, not mean-spirited or posted with the intention of
causing trouble;
- Unlawful, harassing, defamatory, abusive, threatening, harmful, obscene,
profane, sexually oriented, racially offensive or otherwise objectionable
material is not acceptable;
- Be patient - users of all ages and abilities may be taking part in the
relevant site community;
- No spamming - don't cross post your messages to more than one discussion;
- No advertising;
- Posts containing languages other than English may be removed unless allowed
in the local house rules;
- No impersonation. Adopting an inappropriate user name (one that is vulgar,
offensive, etc.) is also unacceptable;
About the law:
- You may not post any defamatory or illegal material of any nature in the site
Communities. This includes text, graphics, video, programs or audio. Posting a
message with the intention of committing an illegal act is strictly prohibited.
- You agree to only post materials to which you have the copyright or other
permission to distribute electronically. You may not violate, plagiarise, or
infringe on the rights of third parties including copyright, trade mark, trade
secrets, privacy, publicity, personal or proprietary rights.
If you're under 16:
- Please get your parents' permission before taking part in any site
discussion.
- Never reveal any personal information about yourself (for example, your
telephone number, home address or email address).
If you breach these Terms of Use:

If you fail to abide by these terms (including the house rules
at this paragraph 11 above), you will be formally warned by email. This warning
may also include a temporary suspension of your ability to participate in any or
all of the sites Community areas.
If after this warning you continue to breach these terms, you
will be prohibited from using site Communities for an extended period of time.
If you post or send offensive or inappropriate content anywhere
on or to site Communities and the owners consider such behaviour to be serious
and/or repeated, the owners may use whatever information that is available to it
about you to stop any further such infringements. This can include informing
relevant third parties such as your employer, school or email provider about the
infringement/s.
The ownwers reserve the right to delete any posting, at any time,
for any reason.
General
- If there is any conflict between these terms and specific terms appearing
elsewhere on the site (including local house rules) then the latter shall prevail.
- If any of these terms are determined to be illegal, invalid or otherwise
unenforceable by reason of the laws of any state or country in which these terms
are intended to be effective, then to the extent and within the jurisdiction in
which that term is illegal, invalid or unenforceable, it shall be severed and
deleted from these terms and the remaining terms shall survive, remain in full
force and effect and continue to be binding and enforceable.
- These terms shall be governed by and interpreted in accordance with the laws
of England and Wales.

Permission is granted to anyone to use this software for any non-commercial purpose,
excluding commercial applications, and to alter it and redistribute it freely,

that you wrote the original software. If you use this software in a product,
an acknowledgment in the product documentation would be appreciated but is

Commercial Use
Commercial Use of Project hurricane in an unaltered form is allow subject to the terms
above.
If commercial use of a dervived, modified or altered version of Project Hurricane
is required, then prior written permission from the authors must be acquired.
Privacy Policy
Intent
From time to time, you will be asked to submit personal information about
yourself (e.g. name and email address etc) in order to receive or use services
on our website. Such services include newsletters, competitions, "Alert
Email",live chats, message boards and site membership.
By entering your details in the fields requested, you enable the owners and their
service providers to provide you with the services you select. Whenever you
provide such personal information, we will treat that information in accordance
with this policy. Our services are designed to give you the information that you
want to receive. The owners will act in accordance with current legislation and
aim to meet current Internet best practice.
Visitor Information
During the course of any visit to the site, the pages you see, along with something
called a cookie, are downloaded to your computer.
Most, websites do this because cookies allow the website publisher
to do useful things like find out whether the computer
has visited the site before. This is done on a repeat visit by checking to see,
and finding, the cookie left there on the last visit.
Use of personal information
When you supply any personal information to the site we have legal obligations towards
you in
the way we deal with that data. We must collect the information fairly, that is,
we must explain how we will use it and tell you if we want to
pass the information on to anyone else. In general, any information you provide
to the site and/or owners will only be used within the site and by its service providers. It
will never be supplied to anyone outside the site without first obtaining your
consent, unless we are obliged or permitted by law to disclose it. Also, if you
post or send offensive or inappropriate content anywhere on or to the site and the
owners considers such behaviour to be serious and/or repeated, the owners can use
whatever information that is available to it about you to stop such behaviour.
This may include informing relevant third parties such as your employer, school
or e-mail provider about the content and your behaviour.
We will hold your personal information on our systems for as long as you use the
service you have requested, and remove it in the event that the purpose has been
met, or, in the case of site membership you no longer wish to continue your
registration as a site member. For safety reasons, however, the owners may store
messaging transcript data (including message content, member names, times and
dates) arising from the use of site Community services for a
period of six months. Where personal information is held for people who are not
yet registered but have taken part in other BBCi services (eg competitions, blog comments),
that information will be held only as long as necessary to ensure that the
service is run smoothly. We will ensure that all personal information supplied
is held securely, in accordance with the Data Protection Act 1998.
If
you are notified on the site that your information may be used to allow the
owners to contact you for "service administration purposes", this means that the
owners may contact you for a number of purposes related to the service you have
signed up for. For example, we may wish to provide you with password reminders
or notify you that the particular service has been suspended for maintenance. We
will not contact you for promotional purposes, such as notifying you of
improvements to the service or new services on the site unless you specifically
agree to be contacted for such purposes at the time you submit your information
on the site, or at a later time if you sign up specifically to receive such
promotional information.
